  • The Williamson County Republican Party’s most recent leadership election featured a heated debate over primary elections versus caucuses. The winning team favored caucus elections, which gives a political party strict control over who can participate.
  • Now, Sen. Johnson is proposing a law that will ban county parties from holding nominating elections via caucus. Under the bill, all political party nominations must be done through a Primary Election for the offices of governor, General Assembly and U.S. House. 

 

Uniformity, Inequity, Exclusion: G.O.P. grandstands against DEI

  • Senate Bill 1083 would enact the "Dismantle DEI Act" which prohibits state agencies, local governments and colleges from basing hiring decisions on any metrics that consider an applicant's race, color, religion, sex, national origin, age, or disability.
  • Republicans are callously blaming DEI for any outcome they don’t like while they have complete control over state government.
  • Instead of canceling DEI initiatives, the Republican Party should be focused on Tennessee’s road funding crisis, underfunded schools and sky-high inflation. 
  • Extra Useless: Republicans have a second bill, SB 1084 *Johnson, called the "Dismantling DEI Departments Act." 

 

State Trigger Ban: G.O.P. bill criminalizes undocumented immigrants

  • The act of being present in the United State in violation of immigration laws is not, by itself, a federal crime. When Republicans use the terms “illegal alien” or “criminal alien,” they’re not using legal terms, they are demonizing a lot of hard working people who are just trying to provide for their families. 
  • Senate bill 1087 takes their demagoguery a big step further. This bill would create a state-level criminal penalty for being undocumented in Tennessee. 
  • But the law would not take effect until states are granted the authority to enforce immigration laws.  

 

G.O.P. bill repeals safeguard on voter registration

  • Senate Bill 823 would repeal Tennessee’s 90-day voter safeguard, which prohibits election officials from purging a voter 90 days before a statewide August election.

 

Golden parachute for lawmakers? 10 years gets a pension, health benefits

8:30 a.m. - State & Local Government - Watch - SB 0722 *Hatcher 

  • Senate Bill 722 will make state lawmakers who serve 10 years in the General Assembly the only state employees who can convert their retirement plan to the state’s old defined benefit pension plan, which was phased out in 2013. 
  • The legislation will also make these lawmakers eligible for supplemental health benefits.

 

Bill sends G.O.P. Attorney General on a witch hunt against cities, counties 

8:30 a.m. - State & Local Government - Watch - SB 0845 *Lowe

  • Republicans are backing a heavy-handed bill that would empower the state’s G.O.P. attorney general to investigate and prosecute cities and counties when he claims they are violating state law. 
  • The attorney general’s office would only have to prove their case in front of a court if the local government challenges the AG’s findings.
  • And if a local government resists, the state finance commissioner could withhold all state funding owed to the city or county.

 

The (Voter) Purge: GOP bill requires voters be purged after two Novembers with no activity

  • Senate Bill 626 makes various changes to Tennessee’s voting laws. The most alarming change would require county election officials to purge voters who haven’t updated their registration or participated in an election after two November elections.

 

State has issued 800 handgun carry permits to people aged 18-20

  • Senate Bill 1318 would codify current practice, allowing the Safety Department to issue handgun carry permits to individuals between the ages of 18-20. 
  • According to the fiscal note, 802 handgun carry permits were issued to individuals between 18-20 years of age in 2024.

Election Laws- As introduced, requires the coordinator of elections, in collaboration with the department of safety and Tennessee bureau of investigation, to create two electronic portals prior to January 1, 2028, for purposes of verifying an applicant's eligibility to vote based upon United States citizenship and conviction of a felony prior to registering the applicant to vote; requires department of safety to issue lawful permanent residents a temporary driver license, instead of a standard license, to aid in determining voter eligibility for someone who presents a Tennessee driver license as identification. - Amends TCA Title 2; Title 4; Title 38; Title 39; Title 41 and Title 55.

 

Creates two portals for the purpose of verifying that only US citizens are registered to vote and no person with a felony conviction is registered.

Election Laws- It requires statewide political parties to nominate their candidates for the general ballot through a primary election. It includes a grandfather clause for counties where a political party nominated candidates by a method other than a primary election in either the 2022 or 2024 election cycles. In those counties, the party may continue using that alternative method for nominating candidates except for the office of governor, members of the Tennessee General Assembly, United States Senate, and United States House of Representatives.

Wine & Wineries- As introduced, exempts the sale of wine for consumption on the premises of a winery or farm wine producer, including the premises of a satellite facility, including tastings and sealed bottles sold at retail for consumption on the premises, from the liquor-by-the-drink tax on alcoholic beverages.  - Amends TCA Section 57-3-207.

Taxes, Sales- As introduced, authorizes certain counties to levy a local option sales tax at the rate of 3.75 percent, instead of a maximum of 2.75 percent, if the revenue from the increase in such tax is used by the county exclusively for the construction of a new county jail or to retire debt, including principal and interest and related expenses, on such construction. - Amends TCA Title 67, Chapter 6, Part 7.

Election Laws- With amendment, requires the Coordinator of Elections to include training on temporary forms of identification issued to non-United States citizens that may not be used as identification for voting purposes as part of the educational standards for election officials.

Taxes, Real Property- As introduced, revises the formula for calculating tax relief on real property owned by eligible disabled veterans so that in determining the amount of relief to such a taxpayer, the assessed value on the first $175,000 of full market value is to be multiplied by the ad valorem tax rate of the jurisdiction instead of by a rate that has been adjusted to reflect the relationship between appraised value and market value in that jurisdiction. - Amends TCA Title 67, Chapter 5, Part 7.

Taxes, Real Property- With amendment, extends the deadline by which a property assessor must determine that property was destroyed or damaged by Hurricane Helene, from January 28, 2025 to April 15, 2025, in order for a property owner to qualify for relief provided by the state.

Bill appears to empower the AG to investigate local governments for suspected preemption violations…

Campaigns and Campaign Finance- As introduced, prohibits political campaign committees formed to support or oppose a measure from receiving, soliciting, or accepting contributions or expenditures from a foreign national; requires such political campaign committees and persons making independent expenditures supporting or opposing a measure to file certain disclosures regarding funding sources with the registry of election finance. - Amends TCA Title 2, Chapter 10.

 

42. SB  0624 *Briggs (HB  0618 by *Wright, Russell, Howell, Jones R, Martin G, Vital, Eldridge)

Public Officials- As introduced, prohibits an individual holding an elected office of a local government from holding another elected office in this state at the same time; grandfathers individuals holding more than one office presently until the terms expire; clarifies that such prohibition does not apply to an office in a political party's state executive committee. - Amends TCA Title 2 and Title 8.

Local Government, General- As introduced, authorizes a member of a local government's legislative body to participate in a scheduled meeting by electronic means if the member is dealing with a family or medical emergency, has been called into military service, or is unable to attend in person due to inclement weather. - Amends TCA Title 5; Title 6; Title 7 and Title 8, Chapter 44.

 

TCOG says the military exemption already exists in state law, this undermines agenda noticing rules in current law

 

44. SB  0621 *Briggs (HB  0456 by *Rudd)

Campaigns and Campaign Finance- As introduced, requires the registry of election finance to provide a copy of the rule promulgated by the registry enumerating examples of the various categories of contributions that constitute "in-kind contributions" and requiring disclosure to each member of the general assembly at the beginning of each yearly session and each candidate for state office within one week of the candidate certifying a treasurer with the registry; deletes obsolete deadline for promulgating such rule. - Amends TCA Title 2, Chapter 10.

 

It requires a corporation that uses corporate funds for communications expressly in support or opposition of a candidate or elected official to report such expenditures in the same manner as PACs.

Election Laws- As introduced, authorizes the county election commission to notify individuals filing a petition for recall, referendum, or initiative of a defect in the petition that must be cured prior to certification for final approval. - Amends TCA Title 2.

Open Meetings - Amends TCA Section 8-44-110. As introduced, expands the requirement that state and local governing bodies make an agenda available to the public prior to regular public meetings of the body to include the governing bodies of certain nonprofit organizations, including nonprofit community organizations that receive federal funding, nonprofit organizations that receive community grant funds from this state or certain funding from local governments, nonprofit organizations created for the benefit of local governments, and nonprofit organizations that provide the metropolitan government of Nashville/Davidson County with certain utility services; requires, rather than permits, such governing bodies that maintain a website to post the agenda to the website.

Local Government, General- As amended, requires all multi-family facilities, buildings, and structures constructed under a voluntary attainable housing incentive program to be deed-restricted for at least 30 years, rather than in perpetuity.

Statutes of Limitations and Repose- As introduced, extends the statute of limitations for criminal prosecution of certain child sexual abuse felonies from 25 years from the child's 18th birthday to 30 years from the child's 18th birthday; extends the statute of limitations for a civil action based on child sexual abuse from 15 years from the child's 18th birthday to 30 years from the child's 18th birthday. - Amends TCA Title 28 and Title 40, Chapter 2.

 

3. SB  1075 *Johnson (HB  1093 by *Sexton, Farmer, Hardaway)

Safety, Dept. of- Adds “machine gun” conversion kits to the state’s existing ban on machine guns. Expands the offense of unlawful possession of a firearm to apply to persons who are prohibited from possessing a firearm to also include handgun ammunition. Stipulates there is no early release eligibility for a person convicted of an aggravated assault when using a firearm from within a motor vehicle.

4. SB  1082 *Johnson (HB  0578 by *Doggett, Powers, Lamberth)

Criminal Offenses- As introduced, adds certain criminal offenses to the list of dangerous felonies for purposes of the offense of possessing a firearm or antique firearm during commission or attempt to commit a dangerous felony. - Amends TCA Title 39, Chapter 17, Part 13.
